I'm certain it's a merlin - used to see quite frequently when I was working in the North Pennines. Whereabouts did you see this one Faz?

Thanks for the reply’s it was a said on another forum it was a kestrel which I did not think it was thought I was going mad lol it’s not my picture unfortunately and it was taken in mainland Spain

What makes people think it's not one or the other? Not sure there's any real feature to determine either way for Kestrel or Merlin is there?

Im doubting myself now lol looking closer at it especially the tail but it still dont look very kestrel to me

As the picture was taken in spain has any one looked at lesser Kestrel? I my self dont think it is a Merlin a bit to pale, and light markings on the on the underwing dont seem to fit a Merlin MIKE

I'm no expert but the underside of the wings looks too pale for a merlin. I'd go for kestrel, but lesser kestrel is a possibility too.

It looks like a moulting male Kestrel with a full crop. Not sure you could say Lesser or Common from this image - I can't anyway!
